General Terms and Conditions.
Tax Revenue Authority resolution no. 274 dated 5 November 2009
The operation of selling material goods (…) amounts to indirect electronic trade since the commercial transaction takes place electronically, but the customer receives the physical delivery of the goods to their address by way of traditional channels, that is, by a carrier or delivery company (see resolution no. 312/E dated 21 July 2008, resolution no. 133/E dated 15 November 2004). For the purpose of VAT, indirect electronic sales operations are the same as sales by correspondence. Hence, they are not subject to the obligation to issue an invoice (unless requested by the customer while ordering), as provided for by article 22 of Italian presidential decree no. 633/1972, nor to certification by way of a sales or tax receipt pursuant to article 2, letter oo), of Italian presidential decree no. 696 dated 21 December 1996. Nevertheless, the payments for the sales must be noted in the Seller’s register as per article 24 of Italian presidential decree no. 633/1972.
The offer and sale of products on the site pyrecostove.com is regulated by the Sales Terms and Conditions below. Before sending their order, we invite our Customers to carefully read the sales terms and conditions. Any amendments or new sales conditions shall take effect from the moment of publication on the site, and will only be applied to sales completed after their publication. When sending an order, the Customer is deemed to have accepted the Sales Terms and Conditions in force at the time.
2) Kind and availability of products
The products are those described on the pages of the pyrecostove.com website, which indicates the name and characteristics of each one; they are all available in our warehouses and ready to be delivered. Pursuant to the law, Sistema SCM Surl undertakes to promptly inform the Customer if the ordered product is not available. In this case, the buyer is contacted promptly and informed about the new amount of time needed to carry out the order, or the possibility of replacing the missing product with one of the same or similar value.
To buy a product, simply click on the “Buy” button under the thumbnails or on the pages with the item details; the products will be added to the cart, where you can change and/or amend the desired quantities.
The purchased goods are delivered by international carriers (we reserve the right to choose the carrier depending on the type of packaging to be sent), after checking payment. Delivery will take place within 30 working days (depending on the delivery destination). When purchasing using PayPal, payments are checked immediately. If you choose the “Bank Transfer” option, checking may take a few days (in this case, we recommend sending a copy of the bank transfer by email). If expressly requested, the goods will be accompanied by an invoice; otherwise, Customers will be sent a receipt. The information provided in the order will be used when issuing the invoice or receipt.
5) Delivery costs
The delivery costs are at the Customer’s expense and are indicated when the order is made. These expenses are calculated on the basis of the destination.
The products are sent on wooden crates with the necessary protection and packaging.
Payment is not made to the carrier; the accepted payment methods are:
– ADVANCE BANK TRANSFER: in this case, it may take a few days to check payment; we recommend sending the receipt of payment by email to firstname.lastname@example.org, while specifying the payment description to speed up the procedure.
PAYPAL: payment is immediate. You can use your credit card (Maestro, Visa, Master Card, Prepaid Card, Discover, American Express, Carta Aura) by simply choosing a user name and password; it is free for customers to create a PayPal account. The transaction cost is at the Seller’s expense.
8) What to do when the goods arrive
When the carrier delivers the goods, Customers must check that the number of packs corresponds to what was ordered and is indicated on the transport document, and that the packaging is intact and not damaged or tampered with; if this is not the case, the recipient must tick “CONDITIONAL ACCEPTANCE” on the carrier’s transport document, and give a description of the problem in pen.
WHEN POSSIBLE, WE RECOMMEND OPENING THE PACKAGING IN FRONT OF THE DRIVER WHO CAN WAIT 1-2 MINUTES WHILE YOU CHECK THAT THE CONTENTS ARE INTACT.
This way, if the material is not intact, Customers can immediately refuse the delivery. The goods will be returned to Sistemi SCM Surl without any further expenses for the Customer, who will naturally be entitled to reimbursement of the order.
9) Guarantee and reporting defects
If the order and the delivery do not correspond, or in the event of non-conformity or defects in the product received, the Customer must make a complaint by sending an e-mail to the address email@example.com no later than 3 days after receiving the goods. The guarantee is not valid if the defects found are due to improper storage after delivery. The terms and conditions for the product guarantee and assistance are those offered by the production company, in compliance with the provisions in EU directive 99/44/EC.
10) Right to withdrawal
Customers have the right to withdraw from the contract, without indicating their reasons, within the deadline of 14 (fourteen) working days as of the date of receipt of the purchased good, as per Italian legislative decrees nos. 206/2005 and 21/2014 – in implementation of directive 2011/83/EU. The withdrawal period lapses after 14 days. Customers who wish to make use of the right to withdrawal must inform the Seller by way of registered post with advice of delivery to the address Sistemi SCM Surl Viale Firenze, 4 – 06042 Campello sul Clitunno (PG), Italy. Alternatively, Customers can send an e-mail to the address firstname.lastname@example.org, so long as this communication is confirmed by sending a registered letter with advice of delivery to the address Sistemi SCM Surl Viale Firenze, 4 – 06042 Campello sul Clitunno (PG) no later than 48 (forty-eight) hours later, or a certified e-mail to the address email@example.com (Italy, Switzerland and Hong Kong only). In order to exercise the right to withdrawal, instead of informing the company in the above manner, the purchased good can be returned, so long as the same conditions are respected. The date of delivery to the carrier shall be proof of dispatch. The communication must contain the declaration that the customer wishes to exercise said right, and indicate all the requested details (order number, invoice number, products in question) and the bank account details for the bank transfer (IBAN, Swift/BIC code of the addressee of the invoice). The goods must nevertheless be returned no later than 30 (thirty) days after receipt of the item. In any case, specific conditions must be observed in order to exercise the right to withdrawal: the purchased item must be substantially intact and sent back in its original packaging; the delivery costs shall be at the Customer’s expense; upon its arrival at the warehouse, the product will be examined to assess any damage or tampering due to packaging that is not suitable for transportation. If there are grounds for the claim, Sistema SCM Surl shall reimburse the amount paid within 30 working days of receipt of the goods, excluding delivery expenses in compliance with art. 5, clause 6, Italian legislative decree no. 185 dated 22/05/1999.
11) Withdrawal by the supplier
Sistemi SCM Surl has the right to withdraw from the sales agreement no later than 30 days after the order date, by simply informing the Customer of its reason:
In these cases, the Customer shall have the right to the exclusive reimbursement of any amounts already paid.
12) Place of Jurisdiction
For any disputes, the place of jurisdiction shall be the Court of Spoleto (province of Perugia, Italy).
